Legislative Decree No. 231 of June 8, 2001 introduced the principle of corporate and organizational liability into our legal system. The Decree provides for the application of sanctions against the organization/company if its senior figures or other employees have committed certain crimes in the course of their duties, in the interest and/or benefit of the organization or company itself.
The introduction of this Decree represented an opportunity for Idal Group to reaffirm the principles of loyalty, faithfulness, and fairness that have always characterized its modus operandi.
To align with the requirements of Legislative Decree No. 231/2001 (Art. 6, Par. 2(c)), “the models must meet the following needs:”
Identify the activities in which crimes may be committed.
Establish specific protocols aimed at planning the training and implementation of the organization’s decisions regarding the crimes to be prevented.
Identify methods for managing financial resources that are suitable for preventing the commission of crimes.
Establish information obligations towards the body responsible for overseeing the functioning and compliance with the models.
Introduce a disciplinary system capable of sanctioning the failure to comply with the measures outlined in the model.
